A Japan Patent Attorneys Association (JPAA) Magazine Article (December, 2020 issue) on Taiwan Patent Invalidation Case by Kai Furihata

Kai Furihata (Japan Patent Attorney)’s latest article “Statistical Analysis of Reasons for Patent Invalidation in Recent Taiwan Invalidation Trials and Case Study for Violating Disclosure Requirements” was published in the Japan Patent Attorneys Association (JPAA) magazine “Patent”(“パテント”) in its December, 2020 issue (VOL. 73).

Based on Taiwan patent invalidation cases and the judgements by the Taiwan Intellectual Property Office and Taiwan Intellectual Property Court in recent years, this article classifies the issues of multiple patent invalidation cases, and analyzes the judgements on these issues. This article further reviews recent representative cases that violated disclosure requirements (supporting requirement, definiteness requirement) and analyzes the current rulings of the Court, and offers strategic advice for future invalidation cases.
