“Taiwan Trademark Practice Guide” by Wisdom to publish on 17 February 2022

Wisdom’s newest book, “Taiwan Trademark Practice Guide” (Japanese) is scheduled to publish on 17 February 2022 by the Japan Institute for Promoting Invention and Innovation. The book can now be ordered at the Institute’s official website, and will be available at various bookstores and websites in the future.

Despite being a Taiwan-based IP firm, with our long history of serving foreign businesses, we published the “Taiwan Patent Practice Guide” in Japanese in April 2020, written and edited with our extensive experience and knowledge. Our goal was to introduce the Taiwan patent system, including patent application procedures, invalidation proceedings and infringement litigation, to Japanese readers. We are delighted to say that the book was well received.

The current book is intended as a guide to Taiwan trademarks for the legal or IP professionals in Japanese businesses, as well as those in charge of international cases at IP or general law firms. In this book, you will find a clear and comprehensive introduction to topics such as developing Taiwan trademark portfolios, the process from application to registration, details on contentious cases, protection of trademark rights, especially on dealing with marks registered in bad faith and counterfeit products, monitoring and preventing counterfeits from spreading on the internet, and the latest interpretations in judicial practice, using many of the latest court cases. Last but not least, we also touch on the contents of the draft amendment to the Trademark Act, which is currently under consideration by the Taiwan Intellectual Property Office and the executive and legislature.

Further, several little "tidbits" about Taiwan trademarks are also included, such as whether jelly and nutritional supplements are similar goods, “defensive trademarks” which are now a thing of the past, and the battle between celebrities and entertainment agencies for band names.

This book provides a systematic explanation of Taiwan's trademark, including the basics and comparison with Japanese regulations, which we believe will be useful to everyone.
